A BILL to amend chapter sixteen of the code of West Virginia, one
thousand nine hundred thirty-one, as amended, by adding
thereto a new article, designated article four-e, relating to
establishing the collaborative practice for emergency
contraception act.
Be it enacted by the Legislature of West Virginia:
That chapter sixteen of the code of West Virginia, one
thousand nine hundred thirty-one, as amended, be amended by adding
thereto a new article, designated article four-e, to read as
follows:
ARTICLE 4E. EMERGENCY CONTRACEPTION.
§16-4E-1. Short title.
This article shall be called the "Collaborative Practice for
Emergency Contraception Act."
§16-4E-2. Collaborative practice.
Not withstanding any other provision of law, a pharmacist may
initiate emergency contraception drug therapy in accordance with
standardized procedures and protocols developed by the pharmacist
and a licensed health care professional licensed to prescribe
medications who is acting within his or her scope of practice.
Prior to performing any procedure authorized under this
section, a pharmacist shall have completed a training program on
emergency contraception, delivered by an American council on
pharmaceutical education providers or another training program
approved by the state board of pharmacy. The training program
shall include, but is not limited to, conduct of sensitive
communications, quality assurance, referral to additional services,
and documentation.
For emergency contraception drug therapy initiated pursuant to
this section, the pharmacist shall provide the recipient of the
emergency contraceptive drugs with a standardized fact sheet that
includes, but is not limited to, the indications for use of the
drug, the appropriate method for using the drug, the need for
medical followup, and other appropriate information. The state
board of pharmacy shall develop this form in consultation with the
department of health and human resources, the American college of
obstetricians and gynecologists, the state pharmacists association,
and any other relevant healthcare organizations. The provisions of
this section do not preclude the use of existing publications developed by nationally recognized medical organizations.
§16-4E-3. Confidentiality.
Nothing in this section shall affect the requirements of
existing law relating to maintaining the confidentiality of medical
records.
